Welcome to It’s Giving Nutrition. These Terms and Conditions govern your use of the It’s Giving Nutrition mobile application and any related services provided by It’s Giving Nutrition by Shemariah.

By downloading, accessing, or using our app, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the app.

1. Acceptance of Terms

By using It’s Giving Nutrition, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, please do not use the app.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will always post the most current version on our app. By continuing to use the app after changes become effective, you agree to be bound by the revised Terms.

3. User Responsibilities

3.1. Users must provide accurate information during the registration process.
3.2. Users are responsible for maintaining the confidentiality of their account information.
3.3. Users agree to use the app for lawful purposes only.

6.1. You acknowledge that the It’s Giving Nutrition App does not guarantee any results in any form or shape and understand that outcomes can differ from one person to another.

7.1. You may use It’s Giving Nutrition only for lawful purposes and in accordance with these Terms.

7.2. You agree not to use the app:

b) To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
c) To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
d) In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

8. Intellectual Property

8.1. The app and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by It’s Giving Nutrition by Shemariah, its licensors, or other providers of such material and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our app, except as incidental to normal use of the app.

9. User-Generated Content

9.1. The app may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post to the app, including its legality, reliability, and appropriateness.

9.2. By posting content to the app, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the app.

10. Health Disclaimer

10.1. The content provided in It’s Giving Nutrition is for informational and educational purposes only and is not intended as medical advice. Always consult a qualified healthcare provider before making any changes to your diet, exercise routine, or lifestyle.

10.2. It’s Giving Nutrition does not replace professional medical advice, diagnosis, or treatment. If you have or suspect that you have a medical problem, contact your health care provider promptly.

10.3. You acknowledge that while It’s Giving Nutrition provides nutrition content created by a qualified nutritionist, it should not be considered as medical advice. The content provided is informational and is not a substitute for professional medical guidance.

10.4. You acknowledge that you should consult your doctor before trying any workout or nutritional plans provided by It’s Giving Nutrition, especially if you have any health concerns or pre-existing medical conditions. This is highly recommended if you have a (family) history of medical conditions, such as but not limited to: joint/muscle/bone problems, heart disease, high cholesterol, high blood pressure, chest pain, obesity, or allergies.

10.5. You acknowledge the risks associated with engaging in physical activity and accept sole responsibility for any physical injuries that may occur while using the It’s Giving Nutrition App or its content.

10.6. If you experience faintness, shortness of breath, or dizziness during physical exercises, discontinue immediately and consult your doctor.

10.7. If you are pregnant, you must obtain approval from your doctor before using the It’s Giving Nutrition App or its content.

11. Disclaimer of Warranties

11.1. The app is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied.

11.2. We do not warrant that the app will be uninterrupted or error-free, that defects will be corrected, or that the app is free of viruses or other harmful components.

12. Limitation of Liability

In no event shall It’s Giving Nutrition by Shemariah, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the app.

13. Subscription and Payments

13.1. Some features of the app may require a subscription. By subscribing, you agree to pay the fees as they become due.

13.2. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

13.3. Refunds are handled in accordance with the platform’s (Apple App Store or Google Play Store) refund policies.

14. Termination

We may terminate or suspend your account and bar access to the app immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
